So I had someone ask me this "NFA question if you know the answer. I have a SBR thinking about selling it. If I send a letter the the NFA making them aware that i am taking the stock off and putting it back in it's original pistol form and seeing if it can be removed or declassified as a NFA item. Would I then be able to polish out my NFA engraving and sell it as a pistol or do I have to keep the engraving?. It's a Arsenal SAM7K"

Since this is an AK I am not aware of any other option. I know it is a waste of a stamp. Does he have any other options???

Probably depends on what you started with. If it was a stripped lower, you (re-)manufactured it, it has to stay marked*. Strip it down to a bare receiver, it's still considered as previously re-manufactured. Dumb, but there are laws regarding manufacturing & marking requirements. If you hadn't built an NFA firearm, you'd be outside the purview of US Code.

I you started with a factory pistol, buff away.

If you were keeping it as a pistol(not selling) buff away your info if you wish(moot point).

*receiver markings on an 'other' firearm don't matter, you manufactured it into another category, marking requirements apply.

If you don't like this answer, I've got a phone number for you... Never mind. You need to get it in writing to be sure.

You are going to have to remove material to get rid of the engraving, then the spot where it was is going to look bad.

It would be much better to sell as an NFA weapon. How much are you wanting for it?

I missed that it is an AK. If you didn't personally build it(Draco, etc), unbolt the stock, take a picture, write a letter(NFA Branch), remove from registry, buff, paint/blue, sell.

Keep all correspondence.

If it is an SBR then should be form 1 and could be done electronically, correct?

Take the stock off and sell it. Send a letter to the ATF telling them to remove it from the registry. Done.
